Assumption of risk, release and waiver of liability
In consideration of being permitted to participate in any training, practice, conditioning, competition or other activity organized by The Winner's Circle Track Club ("the Club"), the undersigned participant, and the parent or legal guardian if the participant is under 18, acknowledges and agrees to the following.
1. Risk. Track and field and general fitness training involve inherent risks including but not limited to muscle strains, sprains, fractures, concussion, heat illness, cardiac events, permanent disability and death. These risks cannot be eliminated regardless of the care taken by coaches and staff.
2. Assumption of risk. The participant knowingly and freely assumes all such risks, both known and unknown, and assumes full responsibility for participation.
3. Fitness to participate. The participant affirms they are physically fit to take part, have disclosed all relevant medical conditions below, and will immediately stop and notify a coach if they experience pain, dizziness or distress.
4. Release. The participant releases and holds harmless the Club, its coaches, staff, volunteers, facility owners and affiliates from any and all claims, demands, losses or liability arising out of participation, including claims based on ordinary negligence, to the fullest extent permitted by law. This release does not apply to gross negligence or willful misconduct.
5. Medical treatment. The participant authorizes the Club to arrange emergency medical treatment and agrees to be responsible for its cost.
6. Media. The participant grants the Club permission to use photos and video taken during activities for promotional purposes, revocable in writing.
7. Conduct. The participant agrees to follow all Club rules, coach instructions and facility policies. Participation may be ended for unsafe conduct without refund.
8. Agreement. This waiver is governed by the laws of the State of Georgia and remains in effect for all future participation until revoked in writing. By typing their name below, the signer agrees this constitutes a legally binding electronic signature.
